Thank you for your interest in the Services offered by RaiseRight, LLC ("RR," "we,” "our,” or "us”). RR knows you care about your privacy. We’ve designed this Policy ("Policy”) to help you better understand how RR: 

  • Collects information about you; 
  • What kinds of information we collect about you; 
  • How we may use your information; 
  • How we may share your information with others; 
  • How we protect your information; and 
  • The choices you have about the collection and use of your information. 

If you have questions about this Policy or practices, or if you need to contact us about the information we collect about you, we’ve provided our contact information for you at the end of this Policy. 

OVERVIEW OF OUR PRIVACY POLICY 

Your Agreement with RR

First, please be aware that this Policy constitutes part of a binding legal agreement between you, as a “User” who accesses or uses the Services, and RR. Before accessing or using the Services (defined below), you ("you," "User," or similar terms) should carefully review the terms and conditions of this Policy, as well as RR’s Terms of Use located at www.raiseright.com/about-us/terms-of-use, which are incorporated into any other agreement with RR by this reference. This Policy applies to your use of all RR-operated and controlled websites, including www.raiseright.com (collectively the “Sites”), the RaiseRight mobile application (the “App”), the RaiseRight browser extension (the "Extension"), and all online services controlled or provided by RR (collectively, together with the Sites and App, our “Services”). 

By using the Services or accessing, installing, downloading, or using the App, Extension, or the Sites, you are indicating your acceptance of the full terms of our Policy and Terms of Use, and you consent to the collection, sharing, security, and uses of your information as described in this Policy. If you do not agree to the full terms of our Policy, you are not permitted to use the Services and you should not use the Services. By continuing to use the Services after this Policy is updated, you consent to any such updated version of this Policy.   

What Does This Policy Cover? 

RR collects certain information from and about you when you use the Services, including information about you that, with reasonable efforts, may be used to identify you ("Personally Identifiable Information"). This Policy explains the information we collect about you, how we use, share, and secure that information, and your choices about the collection and use of your information. This Policy does not apply to the practices of third parties that we do not own or control or that do not have a current contractual relationship with RR. 

Will The Terms Of This Policy Ever Change? 

Yes. RR may modify our Policy at any time. We may contact you directly in the event of changes to this Policy, but since we are not always required to do so, you should periodically review the terms of our Policy to stay informed of any changes and ensure your continued agreement. Your use of the Services after the Last Updated date serves as your consent to these terms, as updated, and your permission to us to collect, use, and share your Personally Identifiable Information under the terms of such updated Privacy Policy.

Modifications to the Policy are effective upon our posting of the amended Policy. The terms of the current Policy supersede all previous notices or statements regarding our privacy practices and become the Policy terms and conditions that govern your use of the Services. You may determine the date the Policy was last amended by referring to the “Last Updated” date shown at the top of this Policy. 

Who Is Eligible To Use The Services? 

RR’s Services are intended for use by adults and are not directed to minors under the age of 18. RR does not knowingly collect Personally Identifiable Information from minors under the age of 18. If we learn that Personally Identifiable Information of a child under the age of 18 has been submitted via or appears on or within Services, RR will take all action necessary to comply with our responsibilities under applicable legal requirements, which may include deletion of any such information. If you think we have received or collected Personally Identifiable Information from a child under the age of 18 through the Services, please contact us at [email protected].  

RR’S COLLECTION AND USE OF YOUR INFORMATION  

Types Of Information RR May Collect About You Include: 

1. Personally Identifiable Information 

RR may collect Personally Identifiable Information about you through your use of our Services in a variety of ways, including information you provide to us to create an account when you join or create a gift card fundraising program, by filling out an online form, by signing up for our email newsletters, or by providing the information to RR. Personally Identifiable Information includes, but is not limited to your first name, last name, birth date, addresses, email address, bank account information, financial card information, driver's license information, phone number, social media account or name, detailed geo-location data, or similar identifying information. We may combine the Personally Identifiable Information we collect about you with additional information we collect about or from you or obtain from third-party sources. RR may use this information for marketing and advertising purposes.  

Please be aware that if you choose to withhold certain Personally Identifiable Information, RR may not be able to provide you with certain Services.  

2. RR Account Information 

RR may require you to register for an account in order to use certain Services (a “RR Account”). RR may collect information about you in connection with your registration for your RR Account, which may include Personally Identifiable Information and other information. You may contact us regarding the information we have collected about you via email at [email protected] or using the contact information provided below. 

3. Financial Account & Payment Information 

If you make a purchase through the Services, the type of information collected will vary depending upon the payment method you choose and may include Personally Identifiable Information such as your date of birth, driver’s license information, shipping information, billing information, financial account information, bank name, bank account name, and number, including the nine-digit bank routing number. We use this information to take and process your order, verify your identity, qualify you for payments, confirm account information and funds availability, process payment transactions, and provide the ordered goods or services to you. We may share financial account and payment information collected about you with our third-party payment processing partners in connection with these actions. 

4. Correspondence Information 

If you send us correspondence via email, the postal service, or another form of communication, we may retain such correspondence and the information provided therein for the uses described in this Policy.    

5. Email & Mailing Address

By submitting your email and mailing address in connection with your account, you agree that RR may use this information to contact you about your account or for other administrative purposes.
 
We may directly send you marketing communications and materials by email, postal mail, and other channels to keep you informed of new products and promotions and to provide other information we think may be of interest to you.

Although email notices are our most common form of notification, you agree that we may contact you by any contact information you have provided to us, including but not limited to telephone, mobile phone, social media account, postal address, fax, or any other method.

6. Promotions, Sweepstakes, Surveys, & Contests Information 

If you register for promotions or sweepstakes provided by RR or our partners, RR or our partners may send you emails or other correspondence regarding the contest for which you registered, and for other contests, promotions, and sweepstakes. From time to time RR may also request information from our users via surveys or contests. Participation in these surveys or contests is voluntary, and you, therefore, have a choice whether or not to disclose this information. 

7. Public Sources & Other Public Information 

RR may also collect information about you from other publicly available sources. For instance, we may receive information from third parties when we process payments for you or may obtain information about you from mailing or email list service providers. In addition, all information you make publicly available in any public or open forum, such as on a social network or another open Internet forum or website, will be considered public information for the purposes of this Policy and may be accessed and collected by RR and others without limitation.   

8. Analytics & Aggregate Information 

We may combine certain information collected from or about you and aggregate it with information collected from other users to analyze users’ use of the Services and improve the quality and value of the Services. We may also collect certain general, non-identifiable, or statistical information about you and your use of the Services through analytics services provided by companies like Google, Inc. and HubSpot (collectively, "Analytics"). Analytics services generally use cookies to help us analyze information about the Users of the Sites and how Users use the Sites. This may include, among other things, such information as (1) website traffic data detailing how many visitors access specific content within Services, (2) for how long you access certain content, and (3) hyperlinks you access via the Services. This data may include demographic, interest-based, and other information about you. Using Analytics, the Sites may collect data about you and your use of the Sites via advertising cookies and anonymous identifiers, in addition to data collected through standard Analytics implementation. We may also use Analytics to help us measure information from emails sent to our users, which helps us track which emails are opened and which links are clicked by recipients. We may share this aggregated, anonymized data stripped of all personally identifying characteristics with third parties. We may also use such combined information without aggregating it to serve you specifically, for instance, to deliver a product or service to you according to your preferences or restrictions. This information presents an overview of our users’ aggregated demographic, preference, and usage habits and allows us to improve our Services and to offer and optimize the provision of preference-based information, promotions, offers, or discounts based on user traffic and behavior.

The Analytics and related services utilized by the Sites may include Google Analytics Advertising Features, Google AdWords, Remarketing with Google Analytics, Google Display Network Impression Reporting, DoubleClick Platform integrations, Google Analytics Demographics and Interest Reporting, and similar services offered by Google and its partners (the “Google Services”). By using the Sites, you consent to the processing of data about you by our Analytics partners consistent with their general practices and practices in relation to the Services. More information about how data is collected and processed in connection with the Google Analytics service may be available at www.google.com/policies/privacy/partners/. You may be able to opt out of the Google Services through Google Analytics’ available opt-outs at tools.google.com/dlpage/gaoptout/, through Ads Settings, Ad Settings for mobile apps, or other available means, including the Network Advertising Initiative (NAI) consumer opt-out, which may be available at www.networkadvertising.org/choices/. Other services may have similar opt-out procedures available through their websites. You may refuse the use of cookies by selecting the appropriate settings on your particular browser. Please note, however, that if you disable cookies or opt out of certain services, you may not be able to use the full functionality of the Sites. 

Please note that Analytics generated about your use of the Services may be transmitted to and stored by Google and similar services. These services may use this information for the purpose of evaluating your use of the Services, compiling reports on activity on the Services, and providing other services relating to the activity and usage of the Services. These services may also transfer this information to third parties where required to do so by law or where such third parties process the information on behalf of the Services. 

9. Cookies, Web Beacons, & Other Tracking Technologies 

Like many other websites, software services, and mobile applications, RR may automatically collect certain information and data from your browser or device through the use of cookies, web beacons, and other tracking technologies. Through these technologies, we may collect information about your use of the Services and other online activities, including certain online activities, after you leave the Services. 

“Cookies” are small pieces of data used by websites and software services to identify repeat users, facilitate the user's ongoing logins and access to a software service or website, and facilitate the use of the software service or website. Persistent cookies may remain on your device’s hard drive after you close your browser or device and may be used by your device on subsequent use of the Services. Persistent cookies can be removed by following the directions according to your particular device or web browser. Session cookies are temporary and disappear after you close your browser or device. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site may not function properly if the ability to accept cookies is disabled. 

Web beacons, pixel tags, and clear GIFs (collectively, “Web Beacons”) are transparent pixel images embedded on web pages that are used in collecting information about website usage, email response, and tracking. Web Beacons are ordinarily not visible to users. Web Beacons allow us to count the number of users who have visited certain web pages, to deliver branded services, and to generate statistics about how the Services are used. 

We may use cookies, log files, Web Beacons, Unique Identifiers, location data and clear GIFs information to: (1) provide and enhance the Services; (2) remember information so that you will not have to re-enter it during your visit or the next time you visit the Site; (3) provide custom, personalized content, correspondences, and information; (4) provide and monitor the effectiveness of the Services; (5) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (6) diagnose or fix technology problems; (7) capture technical information about users’ use of the Services, such as: Internet domain names and host names, IP addresses, browser and operating system information, clickstream patterns, access information, user-agent, HTTP referrer, last URL requested by the user, client-side, and server-side clickstream; (8) help you efficiently access your information; (9) provide advertising to your browser or device; and (10) provide automatic updates related to the Services to you. 

Third-party advertisers may also place or read cookies on your browser. Advertisements that appear in connection with the Services may be delivered (or “served”) directly to you by third-party advertisers. When advertisements are served directly by third-party advertisers, they may automatically receive your IP address and may also download cookies to your computer or use other technologies such as JavaScript and Web Beacons to measure the effectiveness of their ads and to personalize advertising content for you. RR does not have access to or control of any cookies that may be placed by third-party advertisers. This Policy covers the use of cookies by RR and does not cover the use of cookies or other tracking technologies by any of its advertisers. You are responsible for consulting the Privacy Policies and Terms of Service for applicable third-party advertisers. 

You have many choices with regard to the management of cookies on your devices. All major browsers now allow you to block or delete cookies from your system. We encourage you to learn more about your ability to manage cookies and web beacons by consulting the privacy features of your devices and browsers. 

10. Unique Identifiers 

When you use or access the Services, we may automatically access, collect, monitor, store on your device, and/or remotely store one or more Unique Identifiers, such as a universally unique identifier (“UUID”). These Unique Identifiers may be associated with your device, whether or not you establish an RR Account. Unique Identifiers are small data files or similar data structures stored on or associated with your device that uniquely identify your device. A Unique Identifier may be data stored in connection with the device hardware, in connection with the device's operating system or other software, or via data sent to the device by RR. A Unique Identifier may convey information to RR or our Service Provider about how you browse and use the Services and may help us or others provide reports or personalized content and advertisements. A Unique Identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Services. Some features of the Services may not function properly if the use or availability of Unique Identifiers is impaired or disabled. 

11. Log File Information 

Log file information may be automatically reported by your browser or device each time you request to access the Services. When you use the Services, our servers may automatically record certain log file information, which may include your web request, Internet Protocol (“IP”) address, unique device IDs, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Services, domain names, landing pages, pages viewed, and other such information. RR may link this log file to other information RR collects about you via the Services. 

In addition, RR reserves the right to use log files, IP addresses, Cookies, Web Beacons, and other tracking technologies to identify a user when RR (1) feels it is necessary to enforce compliance with the RR Terms of Use; (2) to protect the Services and software, our customers or others; or (3) when RR believes in good faith that the law so requires. 

12. Location Information 

When you access the Services, including visiting the Sites or using any other website or mobile application software provided by RR within the Services, we may access, collect, monitor, and/or remotely store “location data,” which may include your address, zip code, GPS coordinates (e.g., latitude and/or longitude), or similar information regarding the location of you or your computer or another device (“Location Information”). The location of the Organization you are registered through may be used to convey to us information about how you browse and use the Services. Some features of the Services, particularly location-based services, may not function properly if the use or availability of location data is impaired or disabled. 

How Does RR Collect Information About Me, And How Is It Used? 

RR gathers various types of information about you when you access or use our Services. RR may collect information about you in a variety of ways, including: 

  1. Information you provide to us, such as when you register for an account on one of our Sites, Browser Extension, or our App (a “RR Account”), fill out a form providing Personally Identifiable Information (defined and described below) and other information across the various Services, sign up for our email newsletters, or purchase a product or service from RR; 
  2. Information we collect about you automatically, such as through analytics, cookies, log files, and web beacon information;  
  3. Information collected from other websites and services, such as information collected via cookies placed on your web browser or mobile device for the purpose of providing the Services; and
  4. Information provided by the gift card fundraising coordinator of an organization you belong to and/or are associated with.

When you communicate with us, such as via our chat features, we collect the content of your communication.

We may use all of the information we collect from and about you in a number of ways, including to: 

  1. Operate, maintain, improve, and provide the Services; 
  2. Confirm a qualifying purchase or return; 
  3. Confirm whether you qualify for earnings;
  4. Track the redemption of earnings offers and perform other analytics; 
  5. Facilitate, process, and complete any actions or reports you have requested, including purchase orders;  
  6. Respond to your comments and questions and otherwise provide customer service;  
  7. Send you Services or business-related Information, including updates, security alerts, and support and administrative messages;  
  8. Maintain and administer your RR Account;  
  9. Notify you about changes to the Services;  
  10. Provide you with personalized content and information about RR;  
  11. Send you communications about us and our Services, including advertising and marketing materials;  
  12. Provide you with customized and interest-based advertising;  
  13. Fulfill any other purpose for which you provide information, as can be reasonably inferred from the activity or is disclosed to you at the time of collection; and  
  14. Fulfill any other purpose with your consent. 

Do Not Track

RR does not currently employ a process for automatically responding to “Do Not Track” (DNT) signals sent by web browsers, mobile devices, or other mechanisms that may provide consumers a choice regarding the collection of Personally Identifiable Information about an individual consumer’s online activities. As is commonly the case with many other mobile applications and websites, third parties (e.g., advertisers) may be able to collect information, including Personally Identifiable Information, about your online activities over time and across different websites or online services when you use Services. 

Marketing & Third-Party Advertisements   

RR will send you promotional and administrative messages related to your use of the Services.  You may opt out of receiving promotional messages by using the features included in those messages or on your RR account. 

RR may utilize the services of third-party advertising companies, including Google and others, to serve ads to you within our Sites, Extension, or App or to perform remarketing services of our Services on other sites across the Internet. These third parties may collect certain information about your use of the Services and may use technology like cookies to store information about your use of the Services to improve the marketing and advertisements provided to you. The information collected may be reported back to us, and we may link this information to information we have collected about you. More information about interest-based advertising and similar practices may be available at http://www.networkadvertising.org/choices/. 

Shop Online 

The shop online earnings offers on our Sites are provided by FlipGive Inc. (“FlipGive”). If you click on a shop online earnings offer, you may receive transactional or other marketing emails related to shop online earnings offer from FlipGive on our behalf.

Rokt Offers   

When you use our Sites, you may receive targeted offers from Rokt—an independent partner that provides you with special offers from other companies that have partnered with Rokt. Rokt may collect information to target their direct marketing to you (where you have consented to receive it). This means that Rokt uses your information that you provide, so that advertisements can be served to you. More information about Rokt, and how Rokt process your information and how you may exercise your rights over such information can be found in Rokt’s privacy policy, available at: https://www.rokt.com/privacy-policy/. RaiseRight does NOT control Rokt, and all information is collected or processed independently by Rokt, and is in accordance with Rokt’s privacy policy.

HOW WE SHARE YOUR INFORMATION 

How Does RR Share My Information With Others? 

RR does not share, sell, rent, or otherwise disclose your information to third parties without your consent, except as described in this Policy. RR may share Personally Identifiable Information or other information about you with third parties for the following purposes and circumstances: 

  1. With Your Authorization: We have your authorization, whether by the terms of this Policy or as provided through other means; 
  2. To Provide the Services: We need to share your information to provide a product or service you have requested, including sharing the information with companies or organizations connected or affiliated with RR, such as subsidiaries, sister companies, and parent companies to provide the Services; 
  3. Ensure Compliance with the Terms of Use: We may use your Personally Identifiable Information to ensure your compliance with the RR Terms of Use or other usage guidelines for specific products or services;  
  4. Analytics Data & Information: We may share certain service types of information, including information obtained through tools such as cookies, log files, device identifiers, location data, and clear gifs (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with our Service Providers for the purposes described herein. We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties without restriction; 
  5. Business Changes: We may disclose or transfer your Personally Identifiable Information in connection with a potential or actual sale, merger, acquisition, bankruptcy or other transaction in which an affiliate or third party acquires all or any part of our businesses and/or assets; or 
  6. Consistent with its Purpose: The disclosure is consistent with the purpose for which the information was obtained. 

Additional Disclosures: 

RR may share your information with third parties as described in this Agreement, including for the following purposes and circumstances: 

1. To RR Personnel

RR’s personnel and authorized partners may have access to your information as needed to operate and provide the Services during the normal course of business.     

2. To Our Service Providers 

We may share information we’ve collected about you with third-party business partners, including card providers, FlipGive, marketing services providers, fulfillment providers, or other individuals and organizations that help us provide the Services to you ("Service Providers"). Service Providers assist us with our business, such as those who host our servers, analyze our data, provide us with marketing assistance, fulfill gift card orders, process Automated Clearinghouse ("ACH") or credit card payments, facilitate online job applications, and provide search results, allow our Service Providers to confirm their compliance with applicable laws and regulations, and provide customer service. RR will take reasonable steps to ensure that our Service Providers are obligated to protect your information on RR’s behalf. 

Chats with RaiseRight may be saved, stored and used by RaiseRight for customer support quality assurance, and as described in this Policy. Where RaiseRight makes chat features available, we utilize Service Providers such as Zendesk. Our Service Providers that support chat features only use chat communications to support and improve the RaiseRight chat experience.

3. To Financial Institutions

RR may share your Personally Identifiable Information with one or more financial institutions in order to fulfill and carry out the purchase and provision of goods and services requested, including taking and processing your order, verifying your identity, qualifying you for payments, confirming account information and funds availability, process payment transactions, and to provide the ordered goods or services to you. We may share financial account and payment information collected about you with our third-party payment processing partners for the purposes of qualifying and processing payments or for financial provider compliance purposes only. By providing your Personally Identifiable Information to us for these purposes, you authorize us to exchange your Personally Identifiable Information with such financial institutions. 

When users elect to set up online payment by instantly linking their bank account, RaiseRight uses Plaid Inc. (“Plaid”) to gather a User’s data from financial institutions. By using their service, you grant RR and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the  Plaid Privacy Policy. RaiseRight uses Plaid to gather a User’s data from financial institutions when users elect to set up online payment by instantly linking their bank account. 

By using their service, you grant RR and Plaid the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy.   

4. Pursuant to Lawful Requests

We may be required to disclose Personally Identifiable Information or other information pursuant to lawful requests or if we reasonably believe that such action is necessary to (i) comply with the law and the reasonable requests of law enforcement, such as subpoenas or search warrants; (ii) to investigate a breach of an agreement or contravention of law; (iii) to enforce our Terms of Use or to protect the security or integrity of the Services; and/or (iv) to exercise or protect the rights, property, or personal safety of RR, our Users, or others. We generally do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share your RR Account or other information when we believe it is necessary to prevent fraud or other illegal activity perpetrated through the Services or using the RR name, or to prevent bodily harm. This may include sharing information with other companies, lawyers, agents, or government agencies. 

HOW WE PROTECT YOUR INFORMATION  

How Does RR Secure My Information? 

RR makes reasonable efforts to secure and protect the privacy, accuracy, and reliability of your information and to protect such information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, since no data security protocol is impenetrable, RR cannot guarantee the security of our systems or databases, nor can we guarantee that the Personally Identifiable Information we collect about you will not be breached, intercepted, destroyed, accessed, or otherwise disclosed without authorization. As a result, any information you transfer to or from the Services is provided at your own risk. 

Communications you may have with us outside of your RR account via email or postal mail generally should not be considered secure. Therefore, we request that you do not send or post sensitive information through these means. You assume the risk that your communications with RR may not be secure.  

Should I Secure My RR Account And Passwords? 

Yes. Please do your part to help us keep your information secure. In the event you create an RR Account, your account information will be protected by a password you select. We strongly recommend you choose a strong password and take appropriate steps to ensure your password is not disclosed to any other person. You are responsible for maintaining the secrecy of your unique password and account information and all activities that occur under your password or RR Account. RR specifically reserves the right to terminate your access to Services and any contract you have with RR related to Services in the event it learns or suspects you have disclosed your RR Account or password information to an unauthorized third party.  

Your privacy settings may also be affected by changes the social media services you connect to RR make to their services. We are not responsible for the functionality, privacy, or security measures of any third-party organization.  

In the case of our App, RR, and the third parties it allows access to the data submitted by you or collected from you when you access and use our App, will treat your data in accordance with the terms and guidelines contained herein. 

How Can I Safely Use RR's Services? 

Despite RR’s safety and privacy controls, we cannot guarantee that the Services are entirely free of illegal, offensive, pornographic, or otherwise inappropriate material in User Content or that you will not encounter inappropriate or illegal conduct from other users when using the Services. User Content” means content posted, uploaded, published, submitted, transmitted, or otherwise made available through the Services by a User, whether or not the User has an RR Account or whether or not the User owns or created the content. You can help RR by notifying us of any nudity or pornography in User Content, harassment, or unwelcome contact by emailing us at [email protected]. We need all users’ help to report suspicious people and inappropriate content they encounter on RR.

Remember that although using fake names is a violation of the RR Terms of Service, people may not always be who they say they are. You should always be careful when contacting people you do not know in the real world. It is always risky to meet anyone in person whom you don’t know through real-world friends. The following are important safety tips for using RR’s Services: 

  1. Never share your password with anyone; 
  2. Be cautious about posting and sharing Personally Identifiable Information, especially information that could be used to identify you or locate you offline; 
  3. Report users and content that violate our Terms of Service and 

Block and report anyone who sends you unwanted or inappropriate communications.

YOUR CHOICES ABOUT YOUR INFORMATION  

This Policy provides additional information to California, Colorado, Connecticut, Florida, Indiana, Iowa, Kentucky, Montana, Oregon, Texas, Tennessee, Utah, and Virginia residents whose Personally Identifiable Information is collected pursuant to the California Consumer Privacy Act (“CCPA”)(as amended by the California Privacy Rights Act), Colorado Privacy Act ("CPA"), Connecticut Data Privacy Act ("CTDPA"), Florida Digital Bill of Rights (“FDBR”), Indiana Consumer Data Protection Act (“ICDPA”), Iowa Data Protection Act (“IDPA”), Kentucky Data Protection Act (“KDPA”), Montana Consumer Data Privacy Act (“MCDPA”), Oregon Consumer Privacy Act (“OCPA”), Tennessee Information Protection Act (“TIPA”), Texas Data Privacy and Security Act (TDPSA”), Utah Consumer Privacy Act (“UCPA”), Virginia Consumer Data Protection Act ("VCDPA") and other states or countries that may adopt laws after the publication of this Policy (generically referred to as “Privacy laws”). The following rights do not all apply under each of the foregoing Privacy laws. Some states have adopted privacy laws that require specific disclosures. The following explains the rights you may have, depending on where you reside and the jurisdiction that RR is subject to related to your Personally Identifiable Information.  

What Rights Do I Have With Regard To My Information? 

As applicable, the Privacy laws supplement the information contained herein and applies solely to visitors, users and others who reside in jurisdictions that RR is subject to and that apply to you. Some or all of the privacy rights set forth below may apply to you. The following terms in this Section supersede any inconsistent terms in any other sections of this Policy to the extent that any apply to you:

We do not sell your Personally Identifiable Information.  

  1. Your Rights Under Privacy Laws 
  1. Right to Access and Know. You may request that we disclose the following information: 
    1. The categories of Personally Identifiable Information we collected about you and the categories of sources from which we collected such Personally Identifiable Information;
    2. The specific pieces of Personally Identifiable Information we collected about you; 
    3. The business or commercial purpose of collecting or sharing Personally Identifiable Information about you; 
    4. The categories of Personally Identifiable Information about you that we shared (as defined under the applicable privacy law) and the categories of third parties with whom we shared such Personally Identifiable Information; and 
    5. The categories of Personally Identifiable Information about you that we otherwise disclosed, and the categories of third parties to whom we disclosed such Personally Identifiable Information (if applicable). 

Under Privacy laws, the right to obtain “specific pieces” of Personally Identifiable Information does not grant a right to the whole of any document that contains Personally Identifiable Information, but only the right to obtain items of your Personally Identifiable Information. Additionally, you have a right to know “categories” of sources of Personally Identifiable Information and “categories” of third parties to which Personally Identifiable Information is disclosed, but not the individual sources or third parties. RR does not always track individualized sources or recipients. 

  1. Right to Be Informed. You may request the manner in which consent can be revoked, and the procedure for lodging grievances and complaints concerning the processing of your Personally Identifiable Information. In addition, you also have the right to know the following information: 
    1. the purposes of the processing; 
    2. the recipients or categories of recipients to whom the Personally Identifiable Information have been or will be disclosed, in particular recipients in third countries or international organizations;
    3. where possible, the envisaged period for which the Personally Identifiable Information will be stored, or, if not possible, the criteria used to determine that period;
    4. the existence of the right to request from the data controller rectification or erasure of Personally Identifiable Information, or restriction of processing of Personally Identifiable Information concerning you, or to object to such processing;
    5. the existence of the right to lodge a complaint with the applicable governmental authority;
    6. where the Personally Identifiable Information is not collected from you, any available information as to their source; and
    7. the existence of automated decision-making, including profiling, and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for you. 
  1. Right to Request Correction of Your Personally Identifiable Information. You may request that we correct inaccuracies in your Personally Identifiable Information. 
  1. Right to Request Deletion of Your Personally Identifiable Information. You may request to have your Personally Identifiable Information deleted. 
  1. Right to Opt-out of Sharing for Cross-Context Behavioral Advertising. You may request to opt out of the “sharing” of your Personally Identifiable Information for purposes of cross-context behavioral advertising. 
  1. Right to Data Portability. You have the right to request a copy of your data in a machine-readable format. 
  1. Right to Encryption. You may have the right to request that your Personally Identifiable Information be encrypted at rest/while in storage and/or while in transit. 
  1. Right to Restrict Processing.  You may have the right to request the restriction of the processing of your Personally Identifiable Information where one of the following applies: 
    1. The accuracy of the Personally Identifiable Information is contested by you, for a period enabling us to verify the accuracy of the Personally Identifiable Information. 
    2. The processing is unlawful, and you oppose the erasure of the Personally Identifiable Information and request the restriction of their use instead.
    3. We no longer need the Personally Identifiable Information for the purposes of the contemplated processing but it is required by us to exercise or defend legal claims. 
    4. You have objected to processing of your Personally Identifiable Information pending the verification of whether our legitimate grounds of processing override those of yours. 
  1. Right to Object/Withdraw Consent.  You may have the right to object to our reliance on our legitimate interests as the basis of our processing of your Personally Identifiable Information that impacts your rights.  You also may have the right to withdraw your consent to our processing of your Personally Identifiable Information at anytime.  
  1. Right Not to Be Subject to Automated Decision Making. You may have the right to object to decisions based solely on automated processing, including profiling, which produces legal effects concerning you or affecting you. 
  1. Do I Need to Verify My Identity for Requests to Exercise My Rights? 

When receiving a request, we will verify that the individual making the request is the individual to whom the Personally Identifiable Information subject to the request pertains. You may exercise your rights yourself or may use an authorized agent to make requests to disclose certain information about the processing of your Personally Identifiable Information or to delete Personally Identifiable Information on your behalf. If you use an authorized agent to submit a request, we may request that you provide us additional information demonstrating that the agent is acting on your behalf. 

  1. Exemptions to Request to Delete Requests 

Unless otherwise required by applicable law, we are not required to grant your deletion request if retaining the Personally Identifiable Information is necessary for us or our Service Providers to: 

  1. Complete the transaction for which the Personally Identifiable Information was collected, fulfill the terms of a written warranty or product recall, or otherwise perform a contract between us and you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
  3. Debug to identify and repair errors that impact existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act or any other applicable law.
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest when the deletion of the public information is likely to render impossible or seriously impair the achievement of such research, if the consumer has provided informed consent.
  7. For solely internal uses that are reasonably aligned with your expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Internally make otherwise lawful uses of your Personally Identifiable Information that are compatible with the context in which you provided your Personally Identifiable Information. 
  1. What Happens After I Make an Opt-Out Request? 

Once you make an opt-out request, we will wait at least twelve (12) months (unless a different period is legally required) before asking you to reauthorize Personally Identifiable Information sharing with third parties. However, you may change your mind and opt back into Personally Identifiable Information sharing with third parties at any time by mailing us at the address below. 

We will only use Personally Identifiable Information provided in an opt-out request to review and comply with the request. We will act upon your opt-out request within 15 days of receipt.  

  1. We Will Not Discriminate Against You for Exercising Your Rights 

We will not discriminate against you, including employees’, applicants’, and independent contractors’ right not to be retaliated against, for exercising any of your rights under the Privacy laws. We will not: 

  • Deny you goods or services. 
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties. 
  • Provide you a different level or quality of goods or services. 
  • Suggest that you may receive a different price or rate for goods and services or a different level or quality of goods or services. 
  1. Legal Bases for Processing   

We use your Personally Identifiable Information only as permitted by law. Our legal bases for processing Personally Identifiable Information are as follows: 

  • To provide Services to you.
  • To perform our contractual obligations. 
  • To perform pre-contractual measures. 
  • For research and development. 
  • To send you marketing communications. 
  • For compliance, fraud prevention and safety. 
  • To create anonymous data. 
  • To comply with applicable law. 
  • Processing of Personally Identifiable Information with your consent. 
  • Protect your vital interests or those of another natural person. 
  • Processing operations that are pursued by RR for our legitimate interests or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject/data principal which require protection of Personally Identifiable Information. 
  1. Exercising Your Right to Erasure 

If you have such right, and you wish to request the erasure of Personally Identifiable Information stored by us, you may, at any time, contact us via email to make such request as provided below. 

Where we have made Personally Identifiable Information public and are obliged to erase the Personally Identifiable Information, we shall, taking account of available technology and the cost of implementation, take reasonable steps, including technical measures, to inform others processing the Personally Identifiable Information that you have requested erasure. We will arrange the necessary measures in individual cases. 

How Long Does RR Keep My Information? 

We retain your Personally Identifiable Information for as long as necessary to fulfill the purpose for which it was collected and to comply with applicable laws. We use reasonable security precautions to protect your information while in storage.

To determine the appropriate retention period for Personally Identifiable Information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your Personally Identifiable Information, the purposes for which we process your Personally Identifiable Information, whether we can achieve those purposes through other means, and applicable legal requirements.  

ADDITIONAL PROVISIONS REGARDING THE SERVICES & YOUR INFORMATION  

Does This Privacy Policy Apply To Third Party Websites or Applications? 

No. This Policy applies only to RR, the Services, and our collection, use, disclosure, and protection of your information. It does not apply to third-party websites, applications, or services. 

We may provide links or interfaces to other services through the provision of our Services, including to social media sites such as Facebook, LinkedIn, Twitter, and others. However, when you access these third-party services, you become subject to their privacy policies. While RR supports the protection of your privacy, RR expressly disclaims any and all liability for the actions of third parties, including actions relating to the use and/or disclosure of Personally Identifiable Information by third parties. RR’s inclusion of links or interfaces to third-party services does not imply any endorsement of the material on such sites or of their owners or operators. Any information submitted by you directly to these third parties is subject to that third party's privacy policy. 

Please be aware that third-party websites may be able to link certain information about your visit to the Sites to information they may have collected or been provided about you. However, we are not responsible for the privacy practices of any other site, and we are not liable for their use, or misuse, of your information. We encourage you to carefully read the privacy policies of any other websites you may visit to better understand their privacy practices and associated risks and to contact them with any questions.  

Where Is My Information Transferred Or Stored? 

Please note information RR collects about you will be transferred, processed, and/or accessed by us in the United States, or another country where we, or our Service Providers, operate. Please be aware that Personally Identifiable Information may be transferred to and maintained on computers located outside of your state or country. If you are located outside the United States and choose to allow us to collect information about you, please be aware that RR may transfer your Personally Identifiable Information to the United States and process and store it there. By allowing the collection of your Personally Identifiable Information, you consent to have your Personally Identifiable Information transferred to, processed, and stored in the United States or in another country where we, or our Service Providers, operate. 

If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information to a country or jurisdiction that does not have the same data protection laws as your jurisdiction. By submitting your information, registering for, or using the Services, you consent to the transfer, processing, and storage of your information in the United States or any other country in which RR or our Service Providers maintain facilities and to the use and disclosure of information about you as described in this Policy.  

How Do I Exercise My Privacy Rights? 

You may submit your verifiable requests to RR at the address set forth below or by email at [email protected]. To exercise any of these rights or appeal a decision regarding a consumer rights request, contact us at [email protected].

Unless otherwise provided for under applicable Privacy law, only you, or someone legally authorized to act on your behalf, may make a verifiable request to your Personally Identifiable Information. Unless otherwise provided for in applicable Privacy law, we are not required to provide you with Personally Identifiable Information more than twice in a 12-month period.

We will not be able to respond to your request to provide you with Personally Identifiable Information if we cannot verify your identity or authority to make the request and confirm the Personally Identifiable Information relates to you.

Unless legally obligated to respond in a shorter timeframe, we will try to respond to your request within forty-five (45) days of receipt of your written request. If we require more time (up to 90 days), we will inform you of the extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personally Identifiable Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.

We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions.

How Do I Access And Correct My Information? 

You can review and change your First Name, Last Name, or Email Address by logging into the Services and visiting your RR Account profile page. You may also be able to change other information by accessing the Sites, and this includes, your phone number.

You may also send us an email at [email protected] to request access to, correct, or delete any Personally Identifiable Information that you have provided to us. We may be able to delete your Personally Identifiable Information depending on the type and nature of the information, and the requirements of the law. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Content from the Services, copies of your User Content may remain viewable in cached and archived pages or might have been copied or stored by other users. Proper access and use of information provided on the Services, including User Content, is governed by our terms of use at www.raiseright.com/about-us/terms-of-use.
